01Who you're agreeing with
beerreal is built and operated by a small team based in Amsterdam. In these terms "we", "us" and "beerreal" mean the team behind the beerreal app and website; "you" means you, the user. Full corporate details will be published on our imprint page before public launch.
02Eligibility & age
You must:
- Be at least 18 years old.
- Be of legal drinking age where you live (which may be higher than 18).
- Have the legal capacity to enter a binding agreement.
- Not be prohibited from using the service under applicable law or by us under previous enforcement action.
If we discover you don't meet these criteria we'll close your account.
03Your account
You're responsible for activity on your account. Keep your phone and your sign-in method secure. If you think someone has access they shouldn't, message us via the security form immediately.
You can delete your account at any time — see our deletion page or use Settings → Account → Delete account in the app.
04What we provide
beerreal is a real-time social feed for posting beers, joining friends' nights, finding venues, and earning silly badges. The service is provided "as available" — we may change, add, or remove features. We'll tell you in advance about changes that materially reduce what we offer.
05Your content
You keep all rights to the photos, videos, captions, reactions and any other content you post ("Your Content"). You grant us a worldwide, non-exclusive, royalty-free licence to host, store, display, and transmit Your Content for the sole purpose of operating, improving, and securing the service — including making it visible to the friends you choose. This licence ends when you delete the content (subject to a 30-day backup window).
You promise that:
- Your Content is yours, or you have permission to post it.
- It does not break any law or anyone's rights.
- It does not contain other people's faces or identifiable info without their consent.
- Posts featuring minors holding or near alcohol are strictly forbidden.
06Community rules
Don't be that person at the bar. Specifically, don't:
- Glorify dangerous drinking, drink-driving, drinking competitions designed to incapacitate, or alcohol abuse.
- Post content involving minors and alcohol.
- Harass, bully, threaten, dox, or impersonate anyone.
- Post hate speech, sexual content involving minors, terrorist content, or anything illegal in your country or ours.
- Spam, scam, phish, or run pump-and-dump schemes.
- Scrape, reverse-engineer, or rate-limit-evade the service.
- Use the service to promote unlicensed sale of alcohol.
- Use bots or fake accounts.
Under the EU Digital Services Act (Regulation 2022/2065) you can report illegal content via our trust & safety form. We review notices, act on them where required, and inform both the reporter and the user concerned about the outcome and how to contest it. Our DSA point of contact for users is the same channel (Article 12 DSA).
07Suspension & termination
We may suspend or close your account if you break these terms, if we're required to by law, or if leaving the account active poses a security or safety risk. Where reasonably possible we will warn you first and give you a chance to fix the issue. You'll receive a statement of reasons as required by Article 17 DSA, with information on how to appeal. Internal appeals: reply to the suspension email. You also have the right to use a certified out-of-court dispute settlement body under Article 21 DSA.
08Fees & subscriptions
beerreal is free to use. If we ever offer paid features, the price and terms will be shown clearly before purchase, and the payment is handled by Apple (App Store) or Google (Play Store) under their terms.
09Beta features
We sometimes label features "beta", "preview" or similar. Those are experimental. They can change, break, or disappear without notice. They are excluded from any service-level commitments.
10Third-party services
The app uses Apple Maps, Apple Push Notification Service, Sign in with Apple, Sign in with Google, Twilio (SMS), and DigitalOcean (hosting). Their terms apply to those services in addition to ours. We are not responsible for content or services provided by third parties.
11Intellectual property
The beerreal name, logo, "field guide" wordmark, illustrations, icons, app interface and software are owned by the beerreal team and are protected by EU intellectual property law. You can't copy, modify, rebrand or use them commercially without written permission. Press use is allowed under our press kit.
12Disclaimers
beerreal is for fun and connection. It is not medical advice. The "pace warnings" and "responsible streak" features are gentle nudges, not a substitute for self-awareness or professional help. If alcohol is a problem for you, please look at our drink responsibly page or talk to a doctor.
The service is provided "as is" and "as available". We make no warranty that it will always be uninterrupted, error-free, or fit for a particular purpose, beyond the warranties that cannot legally be excluded.
13Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation, gross negligence, intent, or any other liability that cannot be excluded under EU or Dutch law.
Subject to that, our maximum aggregate liability to you arising out of or in connection with the service in any 12-month period is limited to €100. We are not liable for indirect, incidental, consequential or special losses, lost profits, or loss of data, to the extent that exclusion is permitted by law.
You drink your own beer. We don't pour it for you and we are not liable for the consequences of your drinking, your route home, or decisions you make under the influence.
14Right of withdrawal
As beerreal is provided free of charge there is normally nothing to withdraw from. If we ever offer paid digital content and you start using it before the 14-day withdrawal period under EU Directive 2011/83/EU has expired, you waive your right of withdrawal in accordance with Article 16(m) of that directive.
15Disputes & law
These terms are governed by Dutch law. If you are a consumer, the mandatory consumer-protection rules of your country of residence continue to apply. Disputes shall be brought before the competent court in Amsterdam, the Netherlands, except where consumer-protection rules give you the right to bring proceedings in the country where you live.
The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr.
16Changes
We may update these terms. If we make a material change we'll let you know in-app and by email at least 14 days before it takes effect. Continued use after that date counts as acceptance. If you don't accept, you can close your account.
